Gov. Schwarzenegger
signs ocean protection and enhanced water quality legislation
SACRAMENTO, CA (09/20/06) --Gov. Schwarzenegger has signed seven bills that will extend the state’s leadership in protecting the ocean and improve the state’s water quality. "California has a proud history and tradition of leading the nation in protecting the ocean," said Gov. Schwarzenegger. "These bills and the tri-state agreement on Ocean Health I announced earlier today will continue that leadership as we continue to safeguard the beauty of our ocean just as we have worked to preserve the splendor of our land." The seven bills are: SB 497 by Senator Joseph Simitian (D-Palo Alto) requires the California State Lands Commission to adopt regulations on performance standards for the discharge of water pumped into the bottom of a ship to ensure its stability (ballast water) by January 2008. SB 729 by Senator Joseph Simitian (D-Palo Alto) confers on the State Water Resources Control Board (SWRCB) the regulatory power to conduct water quality investigations and impose administrative civil liability for violations of specified water quality requirements, requires the SWRCB and the Regional Boards to make certain enforcement information available on the Internet and requires the Regional Boards to coordinate with the SWRCB on water quality issues and to report rates of compliance. 1843 by the Senate Natural Resources and Wildlife Committee eliminates
the authority provided by the California Coastal Act of 1976 that allows
for diking, filling or dredging for the purpose of erecting boating facilities
in wetland or degraded wetland areas under specified conditions.

1845 by Senator Sheila Kuehl (D-Santa Monica) adds two public members
to the Ocean Protection Council to be appointed by the Governor.

2485 by Assemblymember Dave Jones (D-Sacramento) establishes a
research program focused on reducing sea otter mortality from non-point
source pollution and increases fines for killing a sea otter, marine mammal
or fully protected mammal from $5,000 to $25,000.

2773 by Assemblymember Patty Berg (D-Eureka) implements an agreement
between the three Pacific Coast states whereby each state will limit its
crab fishery in federal waters to in-state fishermen and extends the sunset
date of the steelhead trout catch report-restoration card program.

2972 by Assemblymember Pedro Nava (D-Santa Barbara) provides that
an application for oil and gas development in state waters to be considered
withdrawn if it remains incomplete for a year.
